TOPSAIL BEACH LINENS RENTAL AGREEMENT

Renter agrees to pay the rental rate specified for each item leased hereunder for each time period, (7 DAYS), or fraction thereof that the rental property is charged to the possession of the Renter.

Renter agrees to return the rental property of Topsail Beach Linens immediately upon termination of this contract in the same condition in which property was received, normal wear and tear excepted.

Renter agrees to immediately cease using any rental item if item is found to be unsafe or in disrepair.

Renter shall notify Topsail Beach Linens immediately in either such case, and Topsail Beach Linens agrees to replace the rented item with a similar item in good working condition within 24 hours. Rentals and other charges under this lease shall continue at all times pending such replacement and thereafter, in accordance with the terms of this agreement.

Renter agrees to pay all cleaning, repair, and replacement charges on any rented item which is required upon its return to Topsail Beach Linens.

Renter agrees to pay Topsail Beach Linens in full for all loss or damage to the rented item, whether such loss is caused by theft, accident, or by careless or abusive use, or any other reason.

Harmless and Indemnify Agreement

Renter agrees to hold harmless and indemnify Topsail Beach Linens and its owners, agents, and employees for any injury, loss or damage to any person or item, related to the use of this item. Renter accepts full responsibility for any and all such damage and/or injury that may result.


DELIVERY POLICY:

Normal delivery/pickup hours are between 10am and 3pm on your scheduled date of arrival. All linen items will be placed inside a tote or linen bag outside the cottage or condo. Items may be placed near the front door, carport, or outdoor shower, depending on weather. Check all areas of delivery thoroughly before contacting us about missing linen items. Please place all items in tote and in the same place (as delivery placement) upon departure by 10am. If your delivery has not arrived by 5pm, please contact us at: [email protected].

WE DO NOT OFFER REFUNDS, BUT WE WILL GLADLY MAKE EXCHANGES UPON REQUEST FOR ITEMS OF COMPARABLE VALUE IF PROBLEMS ARE FOUND.

RESERVATION CANCELLATION POLICY:

Cancellations made with less than 24 hours notice will be charged a $30.00 cancellation fee.

No refunds will be given due to weather conditions.

HURRICANE POLICY:

In the event of a mandatory evacuation order, please contact us via email or call our office to make arrangements to have the linen items picked up.

PRIVACY POLICY:

We respect and are committed to protecting your privacy. We do not collect personally identifiable information unless serious purchase inquiries are made. We may automatically receive and record information on our server logs from your browser including your IP address, information and the page(s) you visited. We will never sell or give your personally information to anyone.

SECURITY POLICY:

Our payment and personal information is always safe. Our secure sockets layer (SSL) software is the industry standard and among the best software available today for secure commerce transactions. It encrypts all of your personal information, including credit card number, name, and address, so that it cannot be read over the internet.

RENTAL AGREEMENT:

The renter acknowledges that the linens have been inspected and the linens are determined satisfactory and suitable for the purpose for which it has been leased. The renter shall only use linens in the manner for which it is designed and intended to be used.

Renter recognizes that the property is being received as is and with all faults.

Renter makes no representations, promises, or warranties, either expressed or implied, concerning the merchantability, suitability, or fitness for a party concerning the merchantability, suitability, or fitness for a particular purpose of the property. Renter expressly disclaims any and all representations and warranties, whether arising from statute, common law, custom, or otherwise.

renter assumes all responsibility for rented linens while out of possession of topsail beach linens, and promises to return such linens to topsail beach linens in as good condition as it was at the effective date of the lease. Natural wear from responsible use is expected. Renter shall be liable for any loss, theft, damage, or destruction of leased linens. All linens lost or damaged beyond repair will be paid by the renter at regular replacement price. Accrued rental charges cannot be applied against the purchase price or cost of repairs of such damaged or lost linen items. Scheduled rental rates begin when the equipment leaves our warehouse and continues until returned. Renter shall indemnify and hold topsail beach linens harmless from any and all claims, damages, or proceedings (including all costs, expenses, and attorney’s fees) related to or arising out of renter’s use or possession of any linen items. Topsail Beach Linens shall be used by the renter only. This writing contains and constitutes the entire agreement between the parties.


Topsail Beach Linens

THIS LEASE AGREEMENT CAN ONLY BE MODIFIED BY WRITTEN AGREEMENT SIGNED BY BOTH RENTER AND TOPSAIL BEACH LINENS. THE RENTER REPRESENTS THAT THEY ARE AT LEAST EIGHTEEN (18) YEARS OF AGE AND UNDER NO DISABILITY WHICH WILL PREVENT THEM FROM ENTERING INTO THIS AGREEMENT. RENTER AGREES NOT TO PART WITH OR ASSIGN THIS LEASE OR ANY LINEN ITEMS WITHOUT THE WRITTEN CONSENT OF TOPSAIL BEACH LINENS.
